Welcome back to you all. Hopefully this summer will rival the last for a beautiful summer.
DUES PAYMENT
As a result, DPPO Inc. was created as a non-profit corporation by Letters Patent on June 3, 1955.
The objects of DPPO Inc. were “to safeguard and promote the interests of owners of real property at Duclos Point… (and) to provide for the purchase, supervision and maintenance of all private roads and the recreational oval in the said Duclos Point”. The “private roads” are the roads on Duclos Point beginning at Lamb’s Hideaway and the “rights of way” to Lake Simcoe.
The “recreational oval” is the Park in the centre of Duclos Point. By deed of May 31, 1957 the “Rights of Way” and the Park were conveyed to the DPPO Inc. That conveyance required that the Park “be used as a park and recreational area only” and that if it is used for any other purposes it “shall revert to the grantor”. The by-laws of DPPO Inc. provide that memberships in it “shall be restricted to an owner of property within the limits of Duclos Point”. To provide funds to maintain the Park and the “Rights of Way” DPPO Inc. is authorized to set annual dues payable by all members. Failing payment by any members they lose the right to use the Park and the “Rights of Way”. Upon payment those rights are re-instated. It is very important that all the owners pay their dues to share in the benefits provided by the Parks and Rights of Way through use and added property value. If dues are insufficient to maintain the Parks and Rights of Way, the ownership will revert to Grantor and these facilities will no longer be available to the Property Owners.
